For each category of employees, the legislation establishes a certain mode of work and norms of working hours, which cannot be exceeded without a good reason. What are the norms of working hours, and what is their significance with a 40-hour working week?

Working hours: concept and calculation procedure

The working time norm is the number of hours that a citizen must work for a certain period of time. These norms are established by the Order of the Ministry of Health and social development RF dated 13.08.2009 No. 588n "The procedure for calculating the norm of working time for certain calendar periods of time (month, quarter, year) depending on the established working hours per week."

According to the provisions of this regulatory document, with a 40-hour working week, the norm of working time is calculated taking into account five working days and two days off - Saturday and Sunday. IN this case it is eight hours a day. On the pre-holiday day, the norm of working time is reduced by one hour and amounts to seven hours.

To calculate the norm of working hours per month, the following method is used: the duration of the working week (40 hours) must be divided by 5, multiplied by the number of working days in the month and subtract the number of hours that were reduced before holidays(if available in a particular month).

The norm of working time for the year is calculated in the same way, only the number of working hours per day (eight) is multiplied by the number of working days in a year, after which it is required to subtract from the resulting product the number of hours by which pre-holiday days were reduced throughout the year.

In January 2020, with a five-day working week with two days off, there will be 17 working days and 14 days off.

The working hours in January 2020 will be:

with a 40-hour work week - 136 hours (8 hours x 17 days);

with a 36-hour work week - 122.4 hours (7.2 hours x 17 days);

with a 24-hour work week - 81.6 hours (4.8 hours x 17 days).

In 2020, there will be a total of 248 working days with a five-day working week with two days off, including 5 one-hour working days above, and 118 days off and non-working holidays. The number of working days in 2020 increased by one day compared to 2019, the number of days off and holidays in 2019 and 2020 is the same.

The working hours for 2020 will be:

with a 40-hour work week - 1,979 hours
(8 hours x 248 days - 5 hours = 1,979 hours);

with a 36-hour work week - 1,780.6 hours
(7.2 hours x 248 days - 5 hours = 1,780.6 hours);

with a 24-hour working week - 1,185.4 hours
(4.8 hours x 248 days - 5 hours = 1,185.4 hours).

The procedure for calculating the norm of working time for categories of workers working under different conditions is established by the current legislation. The working time rate depends on how many hours a person has to work in one week. Based on the fact that the working week consists of 40 hours, the calculation of the norms for the month, quarter, half year and year is made.

The norm of working hours for 2018 is the total amount of days and hours to be worked out for a certain period by each employee. It is convenient to track the standard according to the production calendar. It provides monthly calculations of working days, weekends, holidays and norms of working hours for different working weeks. The provisions of the Labor Code of the Russian Federation and the Order of the Ministry of Health of August 13, 2009 No. 588n “On the procedure for calculating the norm of working hours” are taken as the basis for deriving normative values.

Working hours 2018

Determining the standard of working out is necessary for the implementation of monthly payroll. If the amount of time worked according to the time sheet meets the standard, the employee can expect to receive the full amount of remuneration prescribed in the employment contract. If the hours worked are less than the norm, the amount of the salary and the allowances depending on it will decrease in proportion to the output.

The norm of working hours for the 2018 reporting year, broken down by months, varies due to the unequal duration of working weeks for different categories of personnel. In the standard version, the weekly work rate is 40 hours (8 hours daily with two days off, one of which falls on Sunday). For some groups of employees, the employer is obliged to set a reduced working time - 36 hours a week or 24 hours (with daily working hours of 7.2 and 4.8 hours, respectively).

An independent calculation of the standard of working off may also be necessary if underage workers are employed at the enterprise. The limit values ​​for the duration of daily labor for them are determined by Art. 94 of the Labor Code of the Russian Federation.

The monthly norm of working hours for 2018 is the lowest in January. This is due to the long New Year holidays. There is one public holiday in February, before this date the working day for all employees must be reduced by 1 hour.

The duration of working hours is also affected by the postponement of weekends and holidays. For 2018, the list of such transfers was approved by the Government in Decree No. 1250 of October 14, 2017. The standard of working hours for March 2018 takes into account the holiday and the transfer from January 6. Due to this, two additional days of rest and one shortened working day were formed during the month.

The work schedule was adjusted in April as well. In May, there are typical breaks for this month for "long" weekends.

The norm of working hours for June 2018 contains the transfer of the day off, implemented within one month. The hourly standard for working out is set taking into account the public holiday on June 12 and the shortened shift the day before (20 working days x 8 hours in each working day - 1 hour reduction before the holiday = 159 hours per month).

The norm of working hours in July 2018 does not have "holiday" nuances, it reflects only full working days. Consider an example of calculating the July standard:

  • in relation to the base 40-hour week - 176 hours (22 working days x 8 hours of daily work);
  • for a 36-hour weekly output, a standard of 158.4 hours is used (22 working days x 7.2 hours of work per day);
  • with a 24-hour weekly rate, the hourly working time per month will be 105.6 hours (22 working days x 4.8 hours of daily work).

The norm of working hours in August 2018 does not contain holidays or shortened days. There are no additional days of rest in September-October. There is one holiday in November, but there is no reduction in the working day before it. In December there is an intra-month transfer and 1 shortened day on the 29th.

The formula for calculating the norm of working hours

The standard for working time for a certain month is calculated according to the following algorithm:

The duration of the working week in hours / 5 x The number of working days in a particular month according to the production calendar for a five-day working week - Hours for which the working time was reduced in the month in question on pre-holiday dates.

The annual norm of working time is calculated in a similar way, only the number of all working days in a year and the total annual number of hours by which work is reduced on pre-holiday days are taken into account for calculation.

At the same time, it should be borne in mind that the normal duration of the working week should not exceed 40 hours, including during the “six-day work” (Article 91 of the Labor Code of the Russian Federation).

The norm for summarized accounting

When summarizing the accounting of work time, the accountant should be guided by the standards of the settlement interval approved at the enterprise without being tied separately to each month. During one such interval, according to the time sheet, the employee may alternate periods of processing and shortcomings, and according to total amount hours for the required period, compliance with the standard is obtained.

For example, the norms of working hours for 2018 in the date range from January to March with a 40-hour week are 446 hours (136 hours + 151 hours + 159 hours). According to the timesheets for the indicated months, the employee recorded the following data on working out:

  • in January 122 hours at a rate of 136 hours;
  • in February 159 hours with the standard equal to 151 hours;
  • in March, 165 hours were worked, which is 6 hours higher than the base rate of 159 hours.

As a result, for 3 months a person worked the prescribed 446 hours (122 + 159 + 165), there is no overtime, the employee will receive a salary in the prescribed amount.

Production calendar: what is it

Such a concept as a "production calendar" is inextricably linked with working time. Indeed, in the production calendar, all working and non-working days (weekends and holidays) are marked. For ease of use, the production calendar contains both quarterly information about the number of working days and days off, and information for each month. If we talk about an accountant, then this information allows him to accurately and quickly calculate wages, pay sick leave, calculate vacation or draw up a work schedule. As for employees, they can choose the most favorable period for vacation. In other words, the production calendar for 2018 is a universal document that can become the basis for the rational distribution of working time and when maintaining a time sheet in the next year.

Approval of the production calendar for 2018

As an official document, the production calendar for 2018 is not approved. There is neither a federal law nor a government decree, the annex to which would be available for viewing and downloading the production calendar for the next year.

At the same time, article 112 of the Labor Code of the Russian Federation defines non-working holidays, and Decree of the Government of the Russian Federation of October 14, 2017 No. 1250 “On the postponement of days off in 2018”. These regulatory legal acts are the basis for the formation of the production calendar for 2018 with days off and public holidays.

Non-working holidays in 2018 according to the Labor Code of the Russian Federation

Non-working holidays in Russian Federation are:

  • January 1, 2, 3, 4, 5, 6 and 8 - New Year;
  • January 7 - Christmas;
  • February 23 - Defender of the Fatherland Day;
  • March 8 - International Women's Day;
  • May 1 - Spring and Labor Day;
  • May 9 - Victory Day;
  • June 12 - Day of Russia;
  • November 4 - National Unity Day.

As you can see, the weekends of January 6 and 7 (Saturday and Sunday) 2018, coinciding with non-working holidays, have been moved to March 9 and May 2, respectively. Rest days from Saturday 28 April, Saturday 9 June and Saturday 29 December have been moved to Monday 30 April, Monday 11 June and Monday 31 December respectively. With these transfers in mind, the 2018 calendar includes six long weekends and public holidays:

  • from December 30, 2017 to January 8, 2018 inclusive (10 days of New Year holidays);
  • from February 23 to February 25 (3 days on the occasion of Defender of the Fatherland Day);
  • from 8 to 11 March (4 days - International Women's Day);
  • from April 29 to May 2 (4 days for the Spring and Labor Day);
  • from 10 to 12 June (3 days for the celebration of the Day of Russia);
  • from 3 to 5 November (3 days dedicated to the Day of National Unity).

Five-day and six-day working weeks: working hours in 2018

In the rhythm indicated above, in 2018 everyone who is employed on the "five-day" will work. For those working on a six-day week, March 9, April 30, June 11 and December 31, 2018 will remain working days, since the transfer of days off to these dates is planned from Saturdays that coincided with non-working holidays, and for the "six-day" Saturday is not a day off. Therefore, the number of working days, weekends and holidays for these labor regimes in 2018 will vary.

Working hours in 2018

Explanations on working hours

Art. Art. 91 and 92 of the Labor Code of the Russian Federation standardize the length of working hours for certain categories of workers:

  • generally accepted - 40-hour work week;
  • for employees of the enterprise under 16 years old - up to 24 hours / week;
  • from 16 to 18 years old - up to 35 hours / week;
  • for disabled people of 1 and 2 degrees - up to 35 hours / week;
  • for workers in hazardous and heavy industries - up to 36 hours / week.

There are also special arrangements for students and part-time workers. According to the Labor Code of the Russian Federation and the order of the Ministry of Health and Social Development No. 588n dated 13.08.09, any company by collective agreement can establish a different working time, which cannot exceed the maximum established by the Labor Code.

Important!

  • In organizations with a summarized accounting of time for periods equal to a month or a year or another period of time, their norm of the day, week and month is calculated based on the norm of the period of work established in the Labor Code of the Russian Federation.
  • When summarizing overtime, work on holidays and weekends included in this period will not be recognized. Such is recognized as processing over the time period.
  • So, if the period is the 3rd quarter of 2018, then the norm will be 520 hours. This means that overtime is recognized as hours worked from 521 hours.
  • It is worth noting that in this case there will be no violation of the Labor Code of the Russian Federation, since payment for work on holidays / weekends will have to be made in double the amount.

But in any case, the daily rate is calculated from the standard assumption about the length of the week - 5/2. Even if the organization is on a 6-day trip. The norm is calculated by dividing the weekly time by 5:

  • 40 hours / 5 = 8 hours
  • 36h. / 5 = 7.2 hours
  • 24 hours / 5 = 4.8 hours
  • And so on.

The standard version of the production calendar takes into account all the norms of working hours provided for by the Labor Code of the Russian Federation. The accountant can only find out the category of the employee in order to calculate his salary.

The monthly rate (MN) is calculated based on the daily rate (DN):

DN * number of working days in a month = MN,

if a reduction in the working day is expected in a month due to a subsequent holiday, then the number of hours of reduction is subtracted from MN.

For example, the monthly norm of working time in November 2018 with a 5-day (40-hour) week:

(40 hours / 5) * 21 \u003d 8 * 21 \u003d 168 hours.

The annual rate of working hours is calculated by the formula:

DV* number of working days in a year - hours of "decrease".

Holidays and abbreviated days according to the calendar

So, what holidays await us in 2018 and what days will be shortened before these holidays, we will describe in detail below.

Holidays

Thus, the list of official non-working holidays at the federal level is given in Article 112 of the Labor Code.

But Russia is a multi-confessional country, and holidays for its citizens may differ. Therefore, Art. 6 of the Labor Code of the Russian Federation and Article 4 of the Federal Law “On Freedom of Conscience and Religious Associations” stipulate that the authorities of the constituent entities of the Russian Federation may declare holidays and other days, taking into account local traditions and beliefs. So, for example, in the Republic of Tatarstan these are: June 25, August 30, September 1. Holidays of the subject are included in the PC of this subject and affect the norm of working hours.

Holiday-day off

Part 2 of Article 112 fixes: if the holiday fell on a non-working Saturday or Sunday, then instead of this day off, another day of rest is provided - the next working day. This rule is valid for all times except New Year holidays. So, November 4, 2018, National Unity Day, is Sunday, so November 3, 4 and 5 will be days off.

In accordance with Article 113, it is forbidden to involve employees in work on holidays. This is easy to remember using a PC: the dates are highlighted and when you hover the arrows over them, pop-up hints - warnings appear.

Shortening the working day before the holiday

In addition to holidays, the calendar also includes pre-holiday days with a note about the mandatory reduction of the working day by one hour (according to Art. 95 of the Labor Code). The "smart" PC will also take into account the days of transferring holidays from a weekend to a weekday.

Weekend transfers in 2018

There are many holidays in the Russian Federation and sometimes these days do not fall out very conveniently for citizens. In order to optimize rest time, the legislator in the same article 6 of the Labor Code of the Russian Federation provided for the possibility of transferring holidays to other days. It is issued by the annual Government Decree. From the New Year holidays, you can transfer no more than 2 days, which has been done for several years in a row.

In 2018, the transfers will be as follows:

  • From Saturday 6 January to Friday 9 March
  • From Sunday 7 January to Wednesday 2 May
  • From Saturday 28 April to Monday 30 April
  • From Saturday 9 June to Monday 11 June
  • From Saturday 29 December to Monday 31 December

All transfers became officially known in the fall of 2017, but nevertheless, adjustments are still possible, keep this in mind.

Who needs a calendar
