Students and their parents/legal representatives can challenge the decision of the conflict commission through the courts. To do this, you need to file an administrative claim.

The application is drawn up in accordance with Article 125 of the CAS of the Russian Federation and in accordance with the following rules:

  1. The document must be submitted in writing.
  2. Text content must be legible and understandable.
  3. The application must have a header. It contains the name of the body to which the application is submitted, information about the plaintiff and defendant. As a rule, the student himself, his parents, representatives, teacher, classroom teacher, director educational institution. A representative of the conflict commission and the organizers will act as a defendant in court.
  4. Write all contact information in the header of the document. This can be not only a phone number, but also the name of an email or fax.
  5. In the main part of the claim, indicate what rights and interests were violated and why you are going to court.
  6. Be sure to tell us that you appealed to the conflict commission and tried to resolve the problem pre-trial.
  7. The requirements set out in the content must be justified. Refer to regulations, attach evidence, identify witnesses.

The new appeal rules are more child-friendly. Now in Moscow you can see your work in personal account, analyze it, consult with the teacher and parents, and only then decide whether to appeal. In addition, this is the second year that public observers have been present at the appeal. However...

Writing an appeal against violations of the procedure is not difficult: the main thing to remember is that this can only be done immediately, without leaving the exam. This is exactly what, we note, was done during the current campaign by the children who did not have enough additional forms for the Unified State Exam in Literature. And their appeals were granted.

But with an attempt to improve grades, the situation is more complicated. Especially in humanities subjects with their inevitable interpretative bias: “In the exact sciences,” mathematics and physics teachers assured MK, “there are no problems with evaluating work, including during appeals, since a number is a number, and a formula There is a formula - either they are correct or they are not.”

The bulk of this year's appeals are still ahead. However, a couple of typical situations can be considered using the example of last year.

In particular, it seemed to me unfair to reduce the score for the phrase “listen to persuasion” (we were talking about the dialogue between Lopakhin and Ranevskaya in “The Cherry Orchard.” - "MK"). Nikita's problem at last year's Unified State Exam in Russian turned out to be typical. He, like many other graduates, had his grades reduced for, according to the inspectors, incorrectly defining the problem and topic of the texts they received.

Thus, in Nikita’s case, it was believed that the correct answer was “ecology of speech,” and not just “ecology,” as he wrote. True, the members of his appeal committee were polite and friendly. And they even recognized the reason for Nikita’s mother’s reference to a phrase from the keys to the assignment, which allows us to interpret the ecology in question in the literal sense of the word. But the appeal was nevertheless rejected, with the advice to file a complaint with Rosobrnadzor. Mom did just that. And there the rating, although partially, was increased.

However, this happened only at the end of July, when Nikita, with his initial scores, was already forced to enter Moscow State University for paid education...

Single State exam was first carried out in Russia in a number of regions as an experiment in 2001. Since then, it has expanded significantly, and now this form of state certification is considered the only correct one and accepted by the Ministry of Education of the Russian Federation. And this despite the fact that the introduction of the Unified State Exam caused violent protests from schoolchildren and their parents. Today, questions related to this form of knowledge testing have not decreased. On the contrary, their number increases every year. If a student has complaints regarding the first point, he must, without leaving the examination room, immediately after the end of the certification, take forms with the established application form. It must be filled out in two copies. After which the graduate must give it to the members of the State Examination Commission, who must immediately certify them with their signature. One copy remains with the student, the other is transferred to the conflict commission. If the fact of violations is established and recognized, the test may be retaken.

If the student does not agree with the points received, he must, as soon as possible, obtain application forms from the secretary of the conflict commission, which must also be filled out in 2 copies. Be sure to have it certified by the responsible person, who is either the secretary or the manager educational institution, to which the student is assigned. One paper remains with the graduate, the other is under consideration by the commission. In this case, you need to try and find out when the commission meeting on your issue will be held. Bring your passport and stamped pass with you. This way you can defend your case and prove that the mistake is not yours, but the system’s. By the way, the student can invite his parents with him. They must also carry their passports.

After review, the graduate must sign the papers that the forms with the assignments that he sees in front of him belong to him. If the commission sees technical or human errors when checking the test, the points will be recalculated. However, it should be borne in mind that the result can be either increased or decreased.

Such an appeal is submitted on the day of the exam immediately after its completion. If a USE participant wants to file an appeal, he must do so before leaving the PPE (exam reception point).

The appeal is written in two copies and submitted to the authorized representative of the State Examination Commission (GEC), who must affix both copies with his signature, after which one copy is given to the Unified State Examination participant, and the other is transferred to the conflict commission.
The result of the appeal consideration must be provided to the graduate no later than 3 calendar days after its submission. When filing an appeal, you need to find out where you can get an answer about its consideration. Usually, the result of the appeal can be found at your educational institution (educational institution) or at the local education authority (local education authority).

An internal investigation is being conducted into the appeal. If violations of the established procedure for conducting the Unified State Examination are confirmed and it is recognized that they could have a significant impact on the graduate’s work results, then the appeal is granted.

Attention:

An appeal will not be accepted if a violation of the exam procedure and established rules was committed by the Unified State Exam participant himself.

What is the outcome of an appeal if it is successful?

The Unified State Examination result is canceled and the participant is given the opportunity to take the Unified State Examination in this subject on another day. How and when is an appeal filed?

Such an appeal can be filed within two working days after the official announcement Unified State Exam results and familiarization with the result of the work.
If a USE participant does not agree with the result and intends to file an appeal, then within two working days he must draw up an appeal in any form or in the form received from the head of his educational institution (for current year graduates), or the executive secretary of the conflict commission - for graduates of previous years.
The appeal is drawn up in two copies and handed over to the persons indicated above, who must accept it, certifying both copies with their signature. After this, one copy is returned to the Unified State Exam participant, and the other is transferred to the conflict commission.
The Unified State Examination participant must receive information about the time and place of consideration of his appeal.

How is an appeal processed?

The Unified State Examination participant has the right to be present at the procedure for considering his appeal. You must have a passport and a pass with the stamp “Unified State Exam Forms Passed” (or PPE stamp).

Attention:

If the Unified State Examination participant is under 18 years of age, his parents or legal representatives, who must have passports with them (legal representatives must have documents confirming their authority), may be present instead of him or with him during the consideration of the appeal.
Teachers or tutors of the Unified State Examination participant are not allowed to attend the appeal hearing.

The Unified State Examination participant confirms in the appeal protocol that copies of the forms have been presented, the answers in the forms are recognized correctly, and signs the appeal protocol.

If the Unified State Examination participant or his parent (legal representative) does not appear for the appeal hearing, the correct recognition of the forms is confirmed by members of the conflict commission.

Attention:

  • Appeals regarding the content and structure of CIMs are not accepted for consideration.
  • Drafts cannot be appeal material.

The State Examination Participant has the right to file an appeal to the Control Committee in writing:

  • about violation of the established procedure for conducting the Unified State Examination in the relevant academic subject;
  • about disagreement with the assigned points.

The conflict commission does not consider appeals on the following issues:

The student submits an appeal about a violation of the established procedure for conducting the State Examination on the day of the examination in the relevant academic subject to an authorized representative of the State Examination Committee, without leaving the PPE.

In order to verify the information contained in the appeal about violations of the established procedure for conducting state inspection, an authorized representative of the State Examination Committee organizes an inspection with the participation of the organizers, technical specialists in working with software, specialists in conducting training and support laboratory work not involved in the classroom in which the student took the exam, public observers, law enforcement officers, medical workers, as well as assistants providing the necessary technical assistance to students with disabilities health.

The results of the inspection are presented in the form of a conclusion. The appeal and the conclusion on the results of the inspection are transferred on the same day by an authorized representative of the State Examination Committee to the conflict commission.

When considering an appeal about a violation of the established procedure for conducting state inspection, the conflict commission considers the appeal, the conclusion on the results of the inspection and makes one of the decisions:

  • dismissal of the appeal;
  • on the satisfaction of the appeal.

If the appeal is satisfied, the result of the exam, according to the procedure of which the student filed an appeal, is canceled and the student is given the opportunity to take the exam in the relevant academic subject on another day, provided for by the State Examination Schedule.

An appeal about disagreement with the assigned scores, including the results of re-checking the examination work, is filed by GIA participants or their parents (legal representatives) on the basis of identity documents within two working days following the official day of announcement of the GIA results in the relevant academic subject , directly to the conflict commission or to the educational organization in which they were admitted to the State Examination. The head of the educational organization who accepted the appeal transfers it to the conflict commission within one working day after its receipt.

Students and their parents (legal representatives) are informed in advance about the time and place of consideration of appeals.

When considering an appeal about disagreement with the assigned scores, the conflict commission requests from the RCIO printed images of the examination work, electronic media containing files with digital audio recordings of the student’s oral answers, copies of protocols for checking the examination work by the subject commission and examination materials completed by the student who filed the appeal.

These materials are presented to the student (with his participation in the consideration of the appeal).

The student (for students under the age of 14 - in the presence of parents (legal representatives)) confirms in writing that he has been presented with images of the examination work he completed, files with a digital audio recording of his oral answer (in the event of his participation in the consideration of the appeal).

Based on the results of consideration of the appeal about disagreement with the assigned points, the conflict commission makes a decision to reject the appeal and maintain the assigned points or to uphold the appeal and change the points. In this case, if the appeal is granted, the number of previously assigned points may change either in the direction of increasing or decreasing the number of points. Consideration of an appeal about disagreement with the assigned points is carried out within four working days following the day of its receipt by the conflict commission.

If errors are detected in the processing and (or) verification of the examination work, the conflict commission transfers the relevant information to the RCIO in order to recalculate the results of the State Examination.

After approval, the GIA results are transferred to educational organizations, local governments, foreign institutions and founders to familiarize students with the results they received.
